FILIPINA LIVE-IN CAREGIVERS FILED LEGAL ACTION TO PROTECT THEIR CIVIL RIGHTS



Montreal, September 20, 2012 --- After seeing their complaint rejected by the Quebec human rights commission after three years of investigation, PINAY, a local Filipinas' rights organization and eight Filipina live-in caregivers have filed for judicial review of the Commission's decision.

Citing numerous administrative irregularities and serious errors of fact and of law in the Commission's decision, including the failure to heed a Supreme Court decision on the succession's liability for damages resulting from violations of civil rights, the group is asking the Court to send the case back to the Commission for re-investigation. It is also claiming $90,000 in moral damages from the Commission.

The legal action taken before the Quebec Superior Court raises issues of ineffective protection and the lack of access to justice in Quebec civil rights of migrant and domestic workers and how this situation contradicts Canada's obligations under the 2011 ILO International Convention on Decent Work for Domestic Workers , among other laws.
