SUPERIOR COURT DECISION IN THE JOEL DEBELLEFEUILLE APPEAL: TRIAL JUDGES MUST TAKE INTO ACCOUNT RACIAL PROFILING AS A DEFENSE


Montreal, November 17, 2011 --- In an important decision rendered today on the appeal filed by Joel Debellefeuille, a Black man who was intercepted in his BMW by the police in 2009 because of his “Québécois family name”, the Quebec Superior Court ruled that trial judges must take into consideration racial profiling as a defense and a factor that could have influenced police actions in an interception.

The Court also ordered a new trial for Mr. Debellefeuille, by sending the case back to the Municipal Court.
